Terms and Conditions for OdinEyes Aerial Photography
1. Introduction
These Terms and Conditions (“Terms”) apply to all services provided by OdinEyes Aerial Photography, a drone aerial photography business based in the United Kingdom. By commissioning us to carry out work, you agree to be bound by these Terms.
2. Services
We provide aerial photography and videography services using drones in accordance with UK Civil Aviation Authority (CAA) regulations.
3. Booking and Payment
- A non-refundable (except in specific circumstances) deposit of 50% is required to secure your booking.
- The remaining balance is due upon delivery of the final media unless otherwise agreed in writing.
- Payment can be made by bank transfer or other methods as agreed.
4. Cancellations and Postponements
- If you cancel less than 48 hours before the scheduled date, the amount of the deposit will be charged. If we cancel within that time, the deposit will be refunded in full unless you wish to reschedule.
- If weather or safety conditions prevent flight, we will reschedule at no additional cost.
- We reserve the right to cancel or postpone work if conditions make it unsafe or unlawful to operate.
5. Permissions and Legal Compliance
- We are fully insured and operate in line with CAA regulations.
- Clients must ensure appropriate permissions are obtained from landowners or relevant authorities before any flight over private property or restricted areas.
- Flights near people, buildings, or congested areas are subject to strict legal limits and may require additional planning.
6. Client Responsibilities
- You must provide accurate information about the location and nature of the shoot.
- You must not request flights that would breach privacy, safety, or legal boundaries.
7. Intellectual Property
- All images and videos remain the property of Odineyes until full payment is received.
- Upon full payment, a licence is granted to the client for personal or agreed commercial use.
- We reserve the right to use images for promotional purposes unless otherwise agreed in writing.
8. Data Protection
- Any personal data collected will be handled in compliance with the UK General Data Protection Regulation (UK GDPR).
- We do not share client data with third parties except where necessary to provide our services or where required by law.
9. Liability
- While we take every care to deliver high-quality work, we are not liable for any indirect or consequential loss.
- Our liability is limited to the amount paid by the client for the specific service provided.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
11. Changes to Terms
We reserve the right to update these Terms from time to time. The latest version will always be available upon request and on our website (if applicable).
12. Flight Conditions
We take full responsibility to monitor flight conditions leading up to and on the day of the booking. Wind, rain and geomagnetic activity can and do have adverse effects on the drones. If a cancellation must be made due to these factors on the day of the booking, you will not be charged for the remaining booking. Photographs and videos will be supplied in the normal way. The pilot's decision is final.
